2. Definitions and Interpretation

In these Terms and Conditions:

  • "Consumer": means an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
  • "Contract": means the legally binding agreement between you and DA Supermart Ltd for the sale and purchase of Goods ordered through the Website.
  • "Goods" or "Products": means the leather jackets, coats, blazers, outerwear, and related fashion garments offered for sale on the Website.
  • "Order": means your submission of an order to purchase Goods via our online checkout.
  • "Working Day": means any day other than a Saturday, Sunday, or official public/bank holiday in England and Wales.

3. Our Contract With You

3.1 How your order is placed: When you complete the online checkout and click the "Place Order" button, you make an offer to purchase the selected Goods from us in accordance with these Terms.

3.2 Order Acknowledgment: After submitting your Order, you will receive an automated email acknowledging receipt of your order ("Order Acknowledgment"). This email confirms that our systems have received your request, but does not constitute legal acceptance of your Order.

3.3 Contract Formation (Order Acceptance): A legally binding Contract is only formed when we dispatch the Goods to you and send you an official Dispatch Confirmation email containing courier tracking details. Prior to dispatch, we retain the right to decline or cancel any Order.

3.4 Reasons we may decline an order: We may be unable to accept your Order if: (a) the item is unexpectedly out of stock or our inventory count was inaccurate; (b) your payment authorization cannot be obtained or fraud screening triggers an alert; (c) an obvious and unmistakable pricing or descriptive error occurred on the Website; or (d) we are unable to meet a specified delivery deadline. In any such case, we will notify you promptly and issue a full immediate refund.

4. Product Descriptions, Sizing & Natural Leather Characteristics

4.1 Genuine Leather Hides: Many of our garments are crafted from genuine natural hides (such as lamb nappa, cowhide, or suede). Because leather is a natural biological material, slight variations in grain texture, subtle natural markings, and tonal shading are intrinsic characteristics of authentic leather craftsmanship and are not considered defects.

4.2 Product Imagery and Colours: We take reasonable care to display product colours and textures accurately. However, the exact colour you see on your device depends on your monitor calibration, display settings, and lighting conditions. We cannot guarantee that your monitor's display accurately reflects the true garment colour.

4.3 Sizing and Measurements: Outerwear sizing follows standard UK garment specifications. Sizing charts on our Size Guide are provided for general guidance. As jackets are cut and sewn by skilled tailors, slight manufacturing tolerances of ±1–2 cm may occur.

5. Pricing, Currency and Taxes

5.1 Currency: All prices on our Website are quoted in Pound Sterling (£ GBP).

5.2 VAT: Prices include UK Value Added Tax (VAT) where legally applicable at the prevailing rate.

5.3 Delivery Costs: Delivery charges are clearly communicated and itemized in your shopping basket and at the checkout before you finalize your payment.

5.4 Pricing Errors: It is always possible that, despite our reasonable efforts, some Goods may be incorrectly priced on the Website. If we discover a genuine error in the price of the Goods you have ordered: (a) where the correct price is lower than the stated price, we will charge the lower amount and dispatch the item; or (b) where the correct price is higher and the error was obvious and unmistakable such that it could reasonably have been recognized as a mispricing, we will contact you to offer the choice of proceeding at the correct price or cancelling your Order with an immediate full refund.

6. Payment Methods and Security

6.1 Accepted payment methods: We accept all major UK debit and credit cards including Visa, Mastercard, and American Express, as well as digital wallets including PayPal, Apple Pay, and Google Pay.

6.2 Payment Authorization: Payment is pre-authorized and charged upon completion of the checkout process. By submitting payment details, you confirm that you are authorized to use the chosen payment method.

6.3 Security: All online card transactions are processed via secure 256-bit SSL encrypted payment gateways adhering to Level 1 PCI-DSS compliance standards. We never store raw payment card numbers on our servers.

7. Delivery, Transit Times & Risk

7.1 Delivery Destination: We deliver throughout the United Kingdom, including England, Scotland, Wales, Northern Ireland, the Scottish Highlands and Islands, and the Isle of Man.

7.2 Order Handling Time: Our standard order handling time is 0 working days. Orders placed before our daily cut-off time of 2:00 PM GMT on a Working Day are processed and dispatched on the same day.

7.3 Shipping Transit Time: Dispatched parcels are delivered by national courier services (Royal Mail, DPD Local, or Evri) within an estimated 3–5 working days.

7.4 Total Delivery Estimate: The total estimated delivery timeframe is 3–5 working days from the date of order acceptance.

7.5 Passing of Risk and Ownership: Risk of damage to or loss of the Goods passes to you from the moment the parcel is physically delivered to your specified delivery address or into the possession of a safe place / neighbour authorized by you. Ownership (title) of the Goods passes to you once we have received full payment and the Goods have been delivered.

8. Statutory Right of Cancellation (UK Consumer Contracts Regulations 2013)

8.1 Statutory 14-Day Cancellation Right: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Contract without giving any reason within 14 calendar days starting the day after you (or a third party nominated by you) receive the Goods.

8.2 How to Exercise Your Right to Cancel: To cancel, you must notify us of your decision by an unequivocal statement (e.g., an email to hello@dasupermartltd.co.uk) clearly stating your name, order number, and intention to cancel.

8.3 Returning Goods After Cancellation: You must send back the Goods to our designated UK return address without undue delay and in any event no later than 14 calendar days from the day on which you communicated your cancellation to us.

8.4 Reimbursement: We will reimburse all payments received from you for the returned Goods, including the standard outbound delivery cost (if you selected an expedited non-standard delivery service, only the cost of standard delivery is reimbursed). Reimbursement will be made within 14 calendar days of our receipt of the returned Goods or proof of return postage.

8.5 Diminished Value: You are entitled to examine and try on garments indoors to establish their size and fit, as you would in a retail store. If the Goods are returned in a damaged condition showing handling beyond what is necessary to establish nature, fit, and characteristics, we may make a deduction from your refund for diminished value.

9. Voluntary Returns & Sizing Exchanges

9.1 Customer Satisfaction Guarantee: In addition to your statutory cancellation rights, we provide a streamlined returns and sizing exchange service. We charge £0 restocking fees on all eligible returns.

9.2 Return Requirements: Items returned for exchange or refund must be unworn outdoors, unwashed, unaltered, and accompanied by original swing tags and protective garment packaging.

9.3 Return Postage: Unless the item is faulty or delivered in error, the direct cost of returning items for change-of-mind or size swaps is borne by the customer. We strongly recommend using a tracked postal service (e.g. Royal Mail Tracked) with proof of postage.

10. Faulty, Defective or Damaged Products (Consumer Rights Act 2015)

10.1 Legal Guarantee: Under the UK Consumer Rights Act 2015, Goods must be as described, fit for purpose, and of satisfactory quality. Nothing in these Terms affects your statutory legal rights.

10.2 Within 30 Days of Delivery: If an item arrives defective, damaged, or not as described, you have a 30-day statutory right to reject the item and obtain a full immediate refund, including return shipping costs.

10.3 Within 6 Months: If a fault develops within 6 months of delivery that cannot be attributed to normal wear and tear, misuse, or accidental damage, we will repair or replace the garment. If repair or replacement is not possible or economical, you are entitled to a full or proportional refund.

10.4 Reporting Faulty Items: Contact customer support at hello@dasupermartltd.co.uk with photographs and your order number. We will issue a prepaid return shipping label.

11. Customer Accounts and Security

11.1 Account Registration: When creating an account on the Website, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account login credentials and passwords.

11.2 Unauthorized Use: You must notify us immediately if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.

12. Intellectual Property Rights

12.1 Ownership: All intellectual property rights in the Website, including trademarks, trade names, logos, product photography, editorial text, graphics, page layouts, and underlying code, belong exclusively to DA Supermart Ltd or our licensors.

12.2 Restrictions: You may browse and print extracts of the Website solely for personal, non-commercial shopping purposes. You may not copy, reproduce, republish, distribute, scrape, or extract content from the Website for commercial purposes without prior written authorization.

13. User Conduct and Acceptable Use

You agree not to misuse the Website, introduce viruses, trojans, or malicious code, attempt unauthorized access to our server or database, or carry out denial-of-service attacks. Breach of this provision constitutes a criminal offence under the Computer Misuse Act 1990.

14. Promotional Codes and Discounts

Promotional discount codes are subject to specific terms communicated at the time of issue. Codes are valid for specified timeframes, non-transferable, and cannot be redeemed for cash. Unless explicitly stated, promotional codes cannot be combined with other offers or applied retrospectively to completed Orders.

16. Events Outside Our Control (Force Majeure)

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (including severe weather, natural disasters, national courier strikes, postal network failures, epidemics, or telecommunications outages). If such an event occurs, we will contact you as soon as reasonably possible to notify you, and our delivery dates will be extended for the duration of the event.

We process your personal information strictly in accordance with UK data protection legislation, including the UK GDPR and the Data Protection Act 2018. For complete information on how your data is collected, stored, and protected, please review our comprehensive Privacy Policy.

18. Severability and Waiver

If any court or competent authority determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable to the fullest extent permitted by law. Failure by us to enforce any right or provision shall not constitute a waiver of that right.

We will acknowledge your enquiry within 1 Working Day and aim to provide a full resolution within 5 Working Days.

These Terms, any Contract formed under them, and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by, and construed in accordance with, the laws of England and Wales. You and we both agree that the courts of England and Wales shall have exclusive jurisdiction.
